Effective date: ______. HAZE is operated by Clark Street Group LLC ("HAZE," "we," "us," or "our"). Read these Terms carefully. By entering the site, creating or using an account, placing an order, accepting a delivery, or registering as a shop or driver, you agree to every provision below. If you do not agree, do not use HAZE.
HAZE is for adults 21 and older. By using HAZE in any way you represent and warrant that you are at least 21, legally eligible to purchase and receive the products ordered, and that you assume all risks associated with the purchase, delivery, possession, and use of tobacco, nicotine, vapor, and related products. You use HAZE voluntarily and at your own risk.
HAZE provides marketplace technology and local delivery coordination that connects customers with independently licensed shops and independent delivery drivers. HAZE is not the seller, manufacturer, distributor, or retailer of any product, is not a party to the sale between the shop and the customer, and does not take title to any product. To the fullest extent permitted by law, HAZE has no responsibility or liability for the products themselves, their legality, their condition, their effects, or their sale.
The licensed shop that fulfills an order is the seller of record and is solely responsible for the lawful retail sale of its products, including its own licensing, permitting, product sourcing, product safety, warnings, age-restricted-sale compliance, recordkeeping, and all applicable federal, state, and local taxes and reporting. Each shop represents that it holds every license and permit required to sell and dispense the products it lists, and the shop — not HAZE — bears full responsibility and liability for its sales. The shop agrees to indemnify and hold HAZE harmless for any claim arising from its products or sales.
You are solely responsible for everything done through your account and for every order placed under it. You represent and warrant that: (a) all information you provide — including your name, date of birth, delivery details, payment information, and identification — is true, accurate, and your own; (b) you are the person receiving the order and you are 21 or older; (c) you will not order for, gift to, or divert products to anyone under 21 or anyone not legally eligible; and (d) you will present valid, unexpired, government-issued photo identification matching your account at delivery. Providing false information, using another person's account or identification, or arranging receipt by an ineligible person is your sole responsibility and, where applicable, your crime — not HAZE's. You agree HAZE bears no responsibility for it.
You consent to identity and age verification at signup, at checkout, and at delivery. Delivery requires that the recipient present valid government-issued photo identification and that the date of birth on that identification match the date of birth on the account that placed the order. You acknowledge that a valid-but-different identification means the person is not the buyer and the delivery will be refused. HAZE does not warrant or guarantee that every forged, altered, borrowed, stolen, or fraudulent identification will be detected, and to the fullest extent permitted by law HAZE is not responsible or liable for any fraud or misrepresentation committed by a customer, recipient, or any other person.
Delivery drivers are independent contractors, not employees or agents of HAZE. A driver who inspects a customer's identification and attests that the customer is 21 or older is personally and solely responsible for that inspection and attestation. HAZE does not perform the physical ID check and, to the fullest extent permitted by law, is not responsible or liable for a driver's verification, judgment, negligence, act, or omission — including any failure to correctly verify age or identity. Each driver agrees that they alone bear responsibility for completing each delivery lawfully, for confirming the recipient is 21+, and for their own conduct, and each driver agrees to defend, indemnify, and hold HAZE harmless from any claim, loss, penalty, or liability arising from that driver's deliveries, verifications, or conduct.
By signing for a delivery, the recipient acknowledges and confirms that they are 21 or older, that they presented valid matching identification, and that they accept responsibility for the receipt and possession of the products. The electronic signature captured at delivery, together with the driver's attestation, is a binding acknowledgment. Responsibility for the transaction passes to the recipient and, as applicable, the seller of record; HAZE holds no responsibility for a completed, signed, and attested delivery.
You must provide a lawful, safe, reasonably accessible delivery location and remain available to complete the handoff in person. Delivery may be refused if identification cannot be verified, the date of birth does not match the account, the recipient is or appears under 21, the recipient appears intoxicated, the location is unsafe or unlawful, or completing the transaction would violate any law or policy. To the fullest extent permitted by law, risk of loss passes to the customer upon completed handoff, and HAZE is not responsible for theft, loss, damage, or unauthorized access after a completed and documented delivery.
HAZE, a shop, or a driver may decline, cancel, or terminate any order involving suspected fraud, false or mismatched identification, misuse, unsafe conduct, unlawful activity, or inability to complete required verification. The customer is responsible for all losses, costs, fees, and consequences caused by the customer's own false information, unlawful conduct, failure to appear, or inability to lawfully complete the delivery, subject to the posted refund policy.
Nothing on HAZE authorizes any customer, shop, driver, or other user to violate any federal, state, or local law. Each user is solely responsible for complying with every law applicable to that user's own conduct and transaction.
You may not use HAZE to purchase for or divert products to minors or ineligible persons, commit fraud, use or present false identification, interfere with or circumvent age or identity verification, misuse payment methods, resell products unlawfully, threaten or harass shops or drivers, exploit platform vulnerabilities, or engage in any conduct that creates a safety, compliance, or legal risk.
HAZE is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, and any warranty regarding product quality, safety, availability, delivery time, or uninterrupted or error-free operation. To the fullest extent permitted by law, HAZE disclaims all such warranties.
To the fullest extent permitted by law, HAZE and its owners, members, affiliates, contractors, service providers, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, property damage, or any loss arising from the products, the platform, a shop, a driver, a third-party service, any delivery, any verification, or any user's conduct or misconduct. To the fullest extent permitted by law, HAZE is not responsible for another person's fraud, false identification, theft, unlawful possession, misuse, injury, criminal conduct, or breach of these Terms. Where liability cannot be fully excluded, HAZE's total aggregate liability for any claim is limited to the greater of the amount you paid to HAZE for the specific order giving rise to the claim or one hundred U.S. dollars ($100).
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless HAZE and its owners, members, affiliates, contractors, service providers, and representatives from and against any claim, liability, loss, damage, penalty, fine, cost, or reasonable legal fee arising from your use of HAZE, your orders or deliveries, your verifications or attestations, your violation of these Terms or of any law, your false or fraudulent information or identification, or your infringement of any person's rights.
Payments are processed by third-party payment providers (such as Stripe). The shop is the seller of record for the products; HAZE charges applicable platform, service, and delivery fees. You authorize the charging of your selected payment method for the order total and fees. Refunds and cancellations are handled under the posted refund policy. HAZE is not responsible for outages, errors, or acts of any payment provider.
HAZE relies on payment processors, messaging providers, mapping and location services, identity or age-verification services, hosting providers, and other vendors. HAZE does not control and is not responsible for those services or for outages, interruptions, or errors outside HAZE's reasonable control.
To the fullest extent permitted by law, any dispute arising out of or relating to HAZE or these Terms will be resolved by final and binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. You and HAZE waive any right to a jury trial and waive any right to participate in a class, collective, or representative action. Any arbitration will be conducted on an individual basis only.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules, and exclusive venue for any matter not subject to arbitration lies in the state or federal courts located in Florida. If any provision is held unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions stay in full force. These Terms, together with the Privacy Policy, are the entire agreement between you and HAZE regarding the platform. We may update these Terms at any time; your continued use after an update constitutes acceptance.
By providing your mobile number and placing an order, or by being onboarded as a shop or driver, you consent to receive recurring transactional text messages from HAZE about your orders and deliveries — including order confirmations, shop confirmations, driver assignment, and delivery status. Message frequency varies based on your order and delivery activity. Message and data rates may apply. Consent to receive texts is not a condition of any purchase. We do not share your mobile information with third parties or affiliates for their marketing purposes. Reply STOP to any message to opt out of further texts. Reply HELP for help, or contact us at the information published on the site. Carriers are not liable for delayed or undelivered messages.
